Dear Members,
The Association’s Board of Directors is sending this notice to members to address the Association’s storage rooms located on each upper floor of each building next to the elevators. These storage rooms that total three per building are approximately 6’ x 6’ in size, were designed as common area for the storage of items to assist in maintenance of Association property.
Recently the Board had management review the Association’s storage rooms, and the contents within each one. Upon inspection of said rooms numerous issues were discovered, such as some doors were locked and others not, some doors had bike storage posted on the doors and some no indicator sign at all, and items other than bikes were found to be stored in these rooms by owners. Some of items other than bikes discovered included, but were not limited to: paint, suitcases, clothing racks, wagons, strollers, golf clubs, and other miscellaneous items. This caused concern to the Board of risk of liability, as these are common areas are under the responsibility of the Association to mitigate potential liability risks.
After careful review of the Association’s governing documents the Board Considered the following:
· The building floor plans clearly indicate designated storage is provided for each individual unit, indicating adequate space to store bicycles and some other personal items, such as golf clubs.
· The Declaration does not indicate that owners may store any items within the common area storage rooms.
· Condition 2 of the Association’s Rules and Regulations states: The personal property of Unit Owners must be stored in their respective units.
· Condition 16 of the Association’s Rules and Regulations states: Unit Owner and occupants of Units shall park their bicycles and tricycles only within the Unit.
After the careful consideration of the governing documents, results of managements inspection, potential liability risks that further creates mitigation challenges, and that previous management may have misled Unit Owners as to the purpose of these storage rooms. The Board views that these storage rooms were not designed or intended for bicycle or overflow storage, as they are not large enough to benefit all 30 Unit Owners of each building and that individual storage rooms are assigned to each Unit Owner. Therefore, giving credence that the Association storage rooms were designed and intended for the Association to have an available area for storage of items needed to maintain the Association property as required from time to time. The Board has thereby instructed management to perform the following in regard to the Association’s storage rooms:
· To have doors to these storage rooms rekeyed.
· Have all current door signage placed in error by previous management removed.
· Notify Unit Owners with copy of this Notice and the attached Notice.
· Have attached Notice affixed to each storage room door.
· Have Unit Owners remove all personal possessions stored in these storage rooms as indicated by Notice.
· Remove all items not removed by Unit Owners that remain after the date indicated on the Notice.

UNIT OWNERS PLEASE TAKE NOTICE
By Order of the Board of Directors, this storage room will no longer be permitted to store Unit Owner’s personal possessions.
Unit Owners are directed to remove all personal items from within this storage room by May 31st, 2020.
The door to this storage room shall be locked by Management on June 1st, 2020.
Any personal items that are not removed by the aforementioned date will be removed and discarded.
